Terms and Conditions
Please read the following Terms and Conditions. They are the “purchase agreement” between you (“Customer”) and NonprofitComputers.
By accepting delivery and/or license of any product ordered from NonprofitComputers (“NonprofitComputers”), you (“Customer”) agree to be bound by the terms and conditions listed below. You and NonprofitComputers agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and NonprofitComputers. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from NonprofitComputers.

Shipping Methods
- Determination of the carrier will be the sole decision of NonprofitComputers and/or its vendors, distributors, and other affiliates.
- Normal shipping time is 5 to 7 business days.
- All orders require approximately 3-5 business days processing time before shipping.
- NonprofitComputers does not process orders during weekends or holidays.
- No deliveries will be made on weekends or holidays.
- NonprofitComputers does not guarantee shipping dates/times.
- All orders shipped within California will be charged state sales tax.
Price Matching
NonprofiComputers does not price match competitors. For your convenience, our most current pricing is listed on our website and updated in real-time. Prices are non-negotiable.
Sales Tax
Sales tax is only required for orders shipping into states where we have or may have nexus for state tax purposes under applicable laws. Therefore all orders shipping into California will be charged applicable sales tax.
Electronic Waste Recycling Act
The Electronic Waste Recycling Act (“Act”) became law in California on January 1, 2005. The primary objective of this law is to initiate a recycling program for computer products containing chemicals deemed hazardous to the environment. To fund this program, California requires retailers and e-tailers to collect, on the state’s behalf, a fee for each product covered by this law. The consumer pays the fee at the time of purchase of the covered product. This fee will be remitted directly to the state by and only applies to orders shipped within California.
The types of products that we are required to collect this recycling fee include cathode ray tubes, cathode ray tube devices, flat panel screens, and other similar video display devices.
The actual amount of the recycling fee will vary, based on the screen size of the product when measured diagonally, as follows:
- Greater than 4″ and less than 15″: $4.00
- Greater than or equal to 15″ and less than 35″: $5.00
- Greater than or equal to 35″: $6.00
Product Testing
NonprofitComputers, like many other retailers, ships items in the condition they were received from the original manufacturer and/or distributor, vendor, supplier. NonprofitComputers does not conduct product testing before shipping any merchandise.
Return Policy
PLEASE READ THIS ENTIRE POLICY
Computer hardware: Desktop and laptop computers unless otherwise indicated may be returned within 30 days from the original invoice date for a refund as long as you only purchased one computer. There are no returns on any order over one unit (Q=1). A return merchandise authorization number (RMA) is required for all returns. Most products are shipped with a 30-day refund period unless otherwise noted in the product listing. No refunds after 30 days. Customers must inform NonprofitComputers of any order discrepancy within 7 days from the invoice date so that we may investigate and resolve the situation accordingly.
IMPORTANT INFORMATION ABOUT COMPUTER HARDWARE RETURNS:
1. You may only return a computer if you purchased one computer (quantity=1). We are a B2B seller (nonprofits are not “consumers”). Every computer we ship includes a 5-year warranty and support. Orders with any quantities of two or more computers are not returnable. If an order contains two or more computers, no part of the order may be returned.
2. You may only submit one computer return every 30 days. This is to prevent an abuse of our policies, for example a customer ordering “one” unit 25 times in the same day hoping to have a 30-day return policy for all of them, thus attempting to not adhere to the Q=one policy, or any other abuse of our return policy.
3. NonprofitComputers reserves the right to refuse any return and to not offer a return option to any customer. This includes our right to not accept any return when we have determined that there appears to be intent to do harm to NonprofitComputers, the return appears to have abnormal circumstances, the customer has already returned a computer and wants to return another computer at a later date, or the return appears to be an abuse of our policies.
Computer software is not refundable once an order has been placed. Since most software licensing is now delivered online and the license may have been issued prior to the purchaser receiving it, once a software order is placed, it is not refundable at any time and for any reason. NonprofitComputers is not responsible for system/software incompatibility, and incompatibility issues do not qualify for returns. Customers are encouraged to contact the respective software publisher for answers to technical questions, such as versions and minimum system requirements prior to purchase.
Product Return Procedure for Refund:
- Customer wishing to return a hardware product must apply for a return merchandise authorization number (RMA) within 30 calendar days of receipt of the product by contacting NonprofitComputers.
- To receive your RMA contact us and describe in detail the reason for your return. Please be specific. One of our agents will contact you with your RMA number.
- Your RMA number must be clearly marked on the outside of the shipping box and you must include the RMA number and a written description inside the product box.
- Customer is responsible for all shipping costs from and to NonprofitComputers.
- Refunds will be issued within 10 business days after receipt of product.
- Any product “disassembled” by the customer will VOID all warranties and this return/refund policy.
- Customer must return the product using either United Parcel Service (UPS) or Federal Express (FedEx).
- Customer must pack product securely and in accordance with the minimum packing standards of the carrier. If possible, use the original packaging materials. Failure to do so may invalidate the return.
- NonprofitComputers is not responsible for goods that are damaged during shipment or misused/abused by the customer/carrier.
- NonprofitComputers recommends that you to insure the package for an amount equal to the value of the product.
Recertified Computer Warranty
Some recertified hardware products are covered under a warranty that is listed in the description of the product. Warranties cover 100% of parts and labor for the repair or replacement of mechanical failure of computer hardware that prevents the computer from properly functioning under normal conditions. Warranties may be limited on some items. There is no customer-paid deductible for service. Warranties include full replacement if necessary.

- Viruses, malware, spyware, adware, or similar

- Internet connections
- Use of the Internet
- Wireless
- Peripherals
- Laptop batteries
- Laptop screen blemishes
- Internal speakers
- Normal wear and tear
- Versions or compatibility
- Computer speed
- Dropping, spilling, abuse, theft
Recertified Computer Warranty Return Procedure:
- If you are having technical issues with your hardware, please contact NonprofitComputers.

If a defective part needs to be replaced and can be handled by the customer, NonprofitComputers may ship the replacement part to the customer. If requested by NonprofitComputers, customer must ship the original defective part to NonprofitComputers at customer’s expense.

If a defective product needs to be returned for repair or replacement, customer must apply for a Return Merchandise Authorization (RMA) within the warranty period.

One of our agents will provide you with your Return Merchandise Authorization (RMA) Number.

The Return Merchandise Authorization (RMA) Number must be marked on the outside of box.

You must include the Return Merchandise Authorization (RMA) Number and a written description inside the product box.

Customer is responsible for all shipping charges to send the product for repair or replacement.

Should a repair not remedy the issue and a replacement for a defective system not be available, at our discretion a suitable replacement shall be issued.

At the discretion of NonprofitComputers, if a suitable replacement is not available within 10 days from the receipt of your return, NonprofitComputers will issue a credit to your credit card.

Credits are for product cost only and do not include any reimbursement for any shipping charges, including from the original purchase and the return process.

Warranty repairs are handled by NonprofitComputers at our location or a location of our choosing. With the exception of customer replacing a defective part supplied by NonprofitComputers, repairs are not performed “On-Site” by NonprofitComputers or by any paid service technician or company.

NonprofitComputers will not pay third parties for diagnostics or repairs.

Any product previously “disassembled” by the customer will VOID all warranties.

Customer must return the product using either United Parcel Service (UPS) or Federal Express (FedEx).

NonprofitComputers is not responsible for goods that are damaged during shipment or misused/abused by the customer/carrier. We urge you to insure the package for an amount equal to the value of the product.

NonprofitComputers will cover shipping charges to return the repaired product or replacement to the customer via UPS Ground to the lower 48 states.

Items sent to NonprofitComputers that are OUT OF WARRANTY will be returned to customer at customer’s expense unless previously agreed to repair at owner’s expense.

NonprofitComputers is not responsible for any software loaded on the equipment by the customer and does not guarantee that any software that may be loaded will be compatible with the equipment. Check with the software manufacturer for compatibility before purchasing.

NonprofitComputers will not be held responsible for loss of personal/business data. It will be the customer’s sole responsibility to back up any such files.

Any items sent back with no defect may be subject to a service fee. This includes a computer with a loaded operating system that may simply require the correct driver for a device to function.
Physical Damage Policy
Physical damage to any product purchased at NonprofitComputers will effectively void warranty coverage as well as any return/refund/money back guarantee policies. Physical damage includes but is not limited to improper handling and/or any other type of damage sustained by irregular usage.
Recovery Media
Most computer systems no longer include and/or are not shipped to Customer with “Recovery Media”, for example, Disks or CDs used to restore your computer system to it’s factory state. Most do not include Operating System disks, for example MS Windows. This is not specific to systems purchased from any one company, but now standard practice throughout the entire industry.
However, some manufacturers include software on the hard drive that creates recovery media for you. This allows burning your own set of recovery CDs or DVDs – all you need is the blank media. Inclusion of such a recovery utility varies by manufacturer and model; not all manufactures and models include such a utility and NonprofitComputers does not disclose which systems may have that recovery media. For those that include such a utility we recommend you create your own set of recovery media. However NonprofitComputers is not responsible for recovery media in any form and customer should assume that it is not available for any computer purchased from NonprofitComputers.
Technical Support – New Computers/Software
NonprofitComputers does not offer any sort of technical support on products sold as “New” including computers, monitors, and software. We cannot offer advice on compatibility of items, make product recommendations, or provide technical support or sales advice. We post information the manufacturer provides us with for your convenience. Please contact the manufacturer directly for accurate answers to your technical questions or for additional information or specifications that are not posted at NonprofitComputers.
Technical Support – Recertified Computers
NonprofitComputers offers limited, basic technical support, the nature and extent of which shall be at the sole and reasonable discretion of NonprofitComputers. Technical support is limited to hardware covered under our warranty.
Tech support includes assistance with the following covered hardware:

- Optical drive
- RAM
Tech support does not cover or include:
- Operating systems
- Viruses, malware, spyware, adware, or similar

- Peripherals
- Laptop batteries
- Laptop screen blemishes
- Internal speakers
- Normal wear and tear
- Versions or compatibility
- Computer speed
- Dropping, spilling, abuse, theft
Tech support expires at the time of product warranty expiration. For example, a product purchased with 5-year warranty includes 5-years’ of tech support.
Definition of “Recertified” and “Refurbished”
The terms refurbished and recertified are used interchangeable in the industry to describe products that were once in use and then returned their manufacturer, financial company, leasing company, or other asset management provider. These products are inspected, brought back to original manufacturer’s specification then tested and repackaged for sale. Some products are refurbished/recertified by manufacturers and others are refurbished/recertified by qualified third party partners. Refurbished/recertified products represent a great value and we offer them with confidence knowing that every product has been thoroughly tested and examined.
Processing Time
Most orders are processed within approximately 3-5 business days, provided the items are in stock and there are no problems with payment verification. Orders are not processed on weekends and holidays. We do not guarantee processing time. If we provide an approximate or estimated processing time, it is for your information only and may not be accurate or may change.
Backorders
NonprofitComputers may find that it does not have your ordered computer in stock. We will never purposely charge a customer for an item that we do not physically have in stock at the time of purchase or where we have been notified by a distributor, vendor or affiliate that the item is “Out of Stock”.
Occasional inventory discrepancies may occur. In that instance, we can refund your credit/debit card for the item, along with any applicable tax fees and shipping charges. An email will also be sent to alert you of the situation.
Order status
NonprofitComputers will keep you informed of your order status via e-mail. All tracking information will be emailed after your order has been shipped. You may also acquire your order status and other updates by contacting us. We do not guarantee the status of an order or of delivery tracking. If we provide this data, it is for your information only and may not be accurate or may change.
Security
Security is our number one priority. All online transactions are sent through our secure server and encrypted. If you order over the telephone, only trusted, authorized employees will process the payment to make sure your information is handled with the utmost level of security.
Privacy
NonprofitComputers respects your privacy. We will not sell or release your information to anyone except as outlined in our privacy policy found on our website.
Change Orders
You may request a change to your order provided that the order has not already been processed and shipped. Please contact us during our hours of operation to request a change to your order. We strongly discourage sending change order requests via email because it is unlikely we will receive the message in time to make an adjustment due to the sheer volume of emails we receive each day.
Cancelled Orders
You may request that an order be cancelled provided that the order has not already been processed and shipped. Please contact us during our hours of operation to request an order cancellation. You will receive a credit for the full amount to your credit/debit card in approximately 1-2 business days. We strongly discourage sending order cancellation requests via email because it is unlikely we will receive the message in time to void the order due to the sheer volume of emails we receive each day. Once an order has been shipped, it can not be cancelled.
Resellers
We do not currently have a reseller program. NonprofitComputers offers our lowest possible price, and offers these discounts to all of our customers through our website. NonprofitComputers is a reseller to end user customers and does not accept orders from computer dealers, exporters, wholesalers, or other customers who intend to resell the products offered by NonprofitComputers.
Tax Exempt
If you are a California nonprofit and are tax-exempt (from paying sales tax), please contact us and we will provide a Sales Tax Exemption form that you can complete and return with the appropriate documentation.
Product Listings
NonprofitComputers strives for accuracy in all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information contained herein or referenced on our website. Due to human error and other determinates we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information listed is entirely accurate, complete or current, nor can we assume responsibility for these errors.
NonprofitComputers does not guarantee color deviations, the size and configuration of computers (tower, mini-tower, desktop, ultra small form factor, etc.), and other variations. We recommend that you do not use our product listings as a determination of such colors, sizes, and configurations. If you would like a specific size computer (tower, mini-tower, desktop, small form factor, ultra small form factor, etc.), you can place your order over the phone and make your request. Requests are informational only and we do our best to meet a request. However, even with a request, NonprofitComputers does not guarantee color deviations, the size and configuration of computers (tower, mini-tower, desktop, ultra small form factor, etc.), and other variations. NonprofitComputers does not accept returns on any order with more than two computers. The size and configuration of computers delivered does not change our return policy.
In the event a product listed on our website is labeled with an incorrect price due to some typographical, informational, technical or other error, NonprofitComputers shall at its sole discretion have the right to refuse and/or cancel any order for said product and amend, correct and/or remove the inaccurate information.
Additionally, all product information and/or specifications at NonprofitComputers are provided as resources to customers looking for additional information and/or professional opinion. The information may also be available at the website of the manufacturer as well as countless other online websites. NonprofitComputers does not assume responsibility for the information and/or representations included in the information on our website.
NonprofitComputers makes reasonable efforts to maintain the accuracy of competitor product and pricing information displayed on our website. Manufacturers and retailers can change their prices at any time and offer specials and discounts that were not available at the time we gathered our information. Therefore, we do not guarantee that any competitor pricing and/or product information is correct. We encourage users to conduct their own research prior to purchasing. NonprofitComputers cannot be held liable for any actions taken based on the competitive product and/or pricing information provided on our website.
NonprofitComputers shall not be held responsible for any loss or damage, or other liability resulting from such information. To report a pricing error, please contact us.
Product Revisions
NonprofitComputers is not responsible for changes or variations in product specifications and/or physical appearance. This may include changes between the order that you placed and the product that is delivered. Prices and specifications are subject to change without notice. In the interest of our customers, NonprofitComputers puts forth its best efforts to ensure that all product information is up-to-date and factual. Unfortunately there are varying determinates which, although infrequent, could cause the information on our website to become outdated or incorrect without our immediate knowledge. This includes but is not limited to new versions or revisions, color deviations, size and configuration of computers (tower, mini-tower, desktop, small form factor, ultra small form factor, etc.), retail package alterations and other variations that may be considered inconsequential by the manufacturer.
NonprofitComputers relies on the manufacturers, distributors, and/or other vendors to communicate these differences. Presently we have no way of alerting customers prior to purchase in the event the manufacturer, distributor, and/or vendor fails to do so. Consequently, NonprofitComputers will not be held responsible for product revision changes.
All Products Sold “AS-IS” or “With All Faults”
WITH THE EXCEPTION OF OUR LIMITED WARRANTY THAT COVERS THE REPAIR AND/OR REPLACEMENT OF PARTS/COMPUTERS DUE TO MECHANICAL HARDWARE FAILURE ONLY, NONPROFITCOMPUTERS OTHERWISE PROVIDES ITS PRODUCTS AND SERVICES “AS IS” WITHOUT ANY OTHER WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE HEREBY EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY OR COMPLETENESS. THE PRODUCTS AND SERVICES MAY CONTAIN BUGS, VIRUSES, OTHER MALICIOUS CODE, MALWARE, ERRORS, INTERRUPTIONS, PROBLEMS, AND OTHER LIMITATIONS FOR WHICH NONPROFITCOMPUTERS DISCLAIMS ANY RESPONSIBILITY AND LIABILITY.

UNDER NO CIRCUMSTANCES SHALL WE, OUR AFFILIATES, OR ANY OF OUR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR CONTRACTORS BE LIABLE FOR ANY DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, MULTIPLIED OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, IN CONNECTION WITH ANY CONTENT, SUBMISSIONS, USER PROFILES, ACTS OR OMISSIONS OF OTHER USERS, NEGLIGENCE, LOSS OF DATA, LOST BUSINESS OR LOST PROFIT ARISING OUT OF YOUR OR ANY THIRD PARTY’S USE OR THE INABILITY TO USE PRODUCTS OR SERVICES FROM NONPROFITCOMPUTERS. IF YOUR USE OF THE PRODUCTS OR SERVICES RESULTS IN ANY INTERRUPTION, IMPAIRMENT OR LOSS OF, OR YOUR NEED TO SERVICE, REPAIR OR CORRECT, ANY SOFTWARE, HARWARED, EQUIPMENT, SYSTEMS OR DATA, YOU AGREE TO ASSUME AND HOLD US HARMLESS FROM, ANY COSTS AND LOSSES IN CONNECTION THEREWITH.
Limitation of Liability
IN ALL CIRCUMSTANCES NONPROFITCOMPUTERS’ MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. NONPROFITCOMPUTERS SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. NONPROFITCOMPUTERS SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OF REVENUE, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT NONPROFITCOMPUTERS HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
Recordings
NonprofitComputers does not consent to having any telephone calls recorded and reserves the right to terminate any call that is being recorded. Customer agrees not to record any call with NonprofitComputers unless Customer has provided clear and conspicuous notice to NonprofitComputers and has received prior written consent from NonprofitComputers.
Orders
An order is not binding upon NonprofitComputers until it is accepted; NonprofitComputers must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with NonprofitComputers. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.
Shipping Charges
Your total cost for purchase of any product will include the shipping and handling charges shown on your NonprofitComputers invoice. However, your original shipping fees are non-refundable in the case of a returned product. Those fees are paid for the services provided by and to the original carrier, and will not be refunded to you if your item is returned for a refund to NonprofitComputers.
Risk of Loss
NonprofitComputers will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) — excepting software– and risk of loss passes to the Customer upon delivery to the carrier. NonprofitComputers reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow NonprofitComputers to sign appropriate documents on Customer’s behalf to permit NonprofitComputers to protect its purchase money security interest. Title to software will remain with the licensor(s). All software is provided subject to the license agreement of the software maker. Customer agrees to be bound by any software license agreement once the seal on the package is broken or the license information has been provided electronically.
NonprofitComputers will advise Customer of estimated shipping dates. NonprofitComputers will make no guarantees as of the shipping and/or proposed delivery dates of products. NonprofitComputers will, under no circumstances, be responsible for delays in delivery, and associated damages. This includes events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.
Governing Law and Jurisdiction
Any dispute arising out of or related to these Terms and Conditions or the sales transaction between NonprofitComputers and Customer shall be governed by the laws of the State of California, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. NonprofitComputers and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of California, San Diego County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against NonprofitComputers that is more than one year after the date of the applicable invoice.
Severability
If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable California law.
Waiver
The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party’s right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.
Entire Agreement
These Terms and Conditions, together with NonprofitComputers’ invoice regarding the products ordered by Customer, are the complete and exclusive agreement between NonprofitComputers and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between NonprofitComputers and Customer relating to the subject products.
